TIME TO ACT: LIBERATE SECRET TRIAL FIVE AND ABOLISH SECRET TRIALS IN CANADA
Dear Minister Cotler,
On behalf of the Campaign to End Secret Trials in Canada (Toronto), Justice for Mohamed Harkat Committee (Ottawa) and the Coalition for Justice for Adil Charkaoui (Montreal), we are writing to request that you immediately exercise all powers at your disposal to release the five Muslim secret trial detainees and to abolish Security Certificates.
The December 16th 2004 British ruling, that indefinite detention of foreign nationals without trial is incompatible with the European Convention on Human Rights, adds significant weight to the growing public and legal opinion that Canada's similar "security certificate" measures violate fundamental human rights. In their ruling, the British judges demonstrated that such measures are unnecessary and unjustified.
A key basis of the UK ruling was that the measure is blatantly discriminatory. It denies basic rights, such as that of a fair trial, to one group - non-citizens of the UK - while it leaves them intact for everyone else. Canadian security certificates do exactly the same thing. UK Judge Lord Bingham could have been writing about Canada when he remarked, "The measures unjustifiably discriminate against foreign nationals on the grounds of their nationality or immigration status …"
Louise Arbour, United Nations High Commissioner for Human Right and former Canadian Supreme Court judge, earlier echoed the spirit of the British Lords' ruling by calling on governments to avoid infringing human rights in their anti-terror measures. Increasingly, legal authorities are challenging secret trials for immigrants and refugees as incompatible with core human rights and democratic values. New Zealand secret trial detainee Ahmed Zaoui, a refugee imprisoned for two years without charge or access to a fair trial, was released on bail earlier this month in an important ruling in that country. And, as you know, over 60 law organisations and legal experts wrote to you, Immigration Minister Judy Sgro and Public Safety Minister Anne McLellan in October, denouncing Canada's secret trials. UK Judge Lord Hoffman expressed the growing realisation of the legal community that, "The real threat to the life of the nation ... comes not from terrorism but from laws such as these …"
Minister Cotler, we welcome the news, reported in the Globe and Mail (17 December 2004), that security certificates are an issue that have interested you for some time. However, we believe that action is long overdue. You have been responsible for prosecuting these secret trials for over a year. Mohammad Mahjoub has now been imprisoned for four and a half years, Mahmoud Jaballah for three and a half years, Hassan Almrei for three years, Mohamed Harkat for two years, and Adil Charkaoui for over a year and a half. Minister Cotler, you have a reputation of being a defender of human rights. We urge you to take the recent decisions and legal opinions seriously, and to act now to put an end to the painful situation of insecurity in which these five men and their families find themselves by using all powers at your disposal to have them released and secret trials abolished.

Cher Ministre Cotler,
Au nom de la Campagne pour mettre fin aux procès secrets au Canada (Toronto), du Comité Justice pour Mohamed Harkat (Ottawa) et de la Coalition Justice pour Adil Charkaoui (Montreal), nous vous écrivons pour demander que vous exerciez immédiatement tout les pouvoirs qui sont à votre disposition afin de libérer les cinq homme musulmans détenus à la suite de procès secrets et d'abolir les Certificats de sécurité.
Le jugement britannique du 16 décembre 2004 selon lequel la détention de résidents sans sans procès est incompatible avec la Convention européenne sur les Droits humains, ajoute un poids significatif à l'opinion croissante dans la population et la communauté juridique que l'équivalent canadien, les Certificats de sécurité, violent des droits humains fondamentaux. Dans leur jugement, les juges britanniques ont démontré que de telles mesures sont superflues et injustifiées.
Un des fondements du jugement britannique est que la mesure est carrément discriminatoire. Elle nie des droits fondamentaux, comme celui à un procès équitable, à un groupe particulier - les résidents sans citoyenneté- tandis que ceux-ci demeurent intacts pour le reste de la population. Les Certificats de sécurité canadiens font exactement la même chose. Le juge britannique Lord Bingham aurait pu écrire à propos du Canada lorsqu'il a remarqué que « les mesures injustifiables discriminent envers les étrangers sur la base de leur nationalité ou de leur statut d'immigrants. »
Louise Arbour, Haut Commissaire des Nations Unies pour les Droits humains et ancienne juge à la Cour suprème du Canada avait exprimé un avis très semblable à celui de la cour des Lords britannique en appelant les grouvernements à éviter les violations de droits humains dans leurs mesures anti-terroristes. De plus en plus, les autorités légales contestent les procès secrets pour les immigrants et réfugiés comme étant incompatibles avec les droits humains de base et les valeurs démocratiques. Le détenu sans procès de Nouvelle-Zélande, Ahmed Zaoui, un réfugié emprisonné pour deux ans sans accusations ou accès à un procès équitable, a été libéré sous caution au début décembre à la suite d'un jugement important dans ce pays. Et comme vous le savez, plus de 60 organisations juridiques et experts légaux vous ont écrit, ainsi qu'à la Ministre de l'Immigration Judy Sgro et à la Ministre de la Sécurité publique Anne McLellan en octobre, dénonçant les procès secrets au Canada. Le juge britannique Lord Hoffman a exprimé la prise de conscience croissante de la communauté des juristes que « la véritable menace à la vie de la nation. ne vient pas du terrorisme mais de lois comme celle-ci. »
Monsieur le Ministre, nous accueillons favorablement la nouvelle, rapportée dans le Globe and Mail du 17 décembre 2004, que les Certificats de sécurité ont été un sujet de préoccupation pour vous depuis un certain temps. Par contre, nous croyons que le temps d'agir sur ce dossier est venu depuis longtemps. Vous êtes responsable de l'administration des procès secrets depuis plus d'un an. Mohammad Mahjoub est emprisonné depuis quatre ans et demi, Mohamed Harkat depuis deux ans, Adil Charkaoui depuis plus d'un an et demi.
Monsieur le ministre, vous avec la réputation d'être un défenseur des droits humains. Nous vous prions de prendre au sérieux les récentes décisions et les avis légaux que vous avez reçus sur ce sujet et d'agir immédiatement pour mettre fin à la situation de souffrance et d'insécurité dans laquelle ces cinq hommes et leurs familles se trouvent en faisant tout ce qui est en votre pouvoir pour les faire libérer et abolir les procès secrets.
