Justice Noël says No. Again.
His reasons? National Security. Again.
"The Court concluded that the disclosure of the majority of the information sought by Mr. Harkat would injure national security or endanger the safety of a person. Disclosure of such information is prohibited by the Immigration and Refugee Act. The constitutionality of this prohibition was not at issue in this motion. The Court also found that some of the information sought by Mr. Harkat amounted to impermissible requests for discovery. Consequently, the motion for disclosure was denied for the most part. However, the Ministers were ordered to provide Mr. Harkat with a summary of the further information disclosed to the court in accordance with the requirements of the Supreme Court of Canada’s decision in Charkaoui v. Canada 2008 SCC 38. "
