There were tears in Federal Court yesterday when a judge refused to quash a security certificate that has kept a Montreal man behind bars without charge for almost two years. Supporters and family of Adil Charkaoui had their hopes dashed when Judge Simon Noel ruled Canada's spy agency did nothing wrong when it destroyed notes related to the case. Judge Noel provided no explanation for his decision. A written ruling is expected to follow. Mr. Charkaoui, who was arrested in May 2003 on suspicion of having ties to al-Qaeda, will be back in court Feb. 7 and 8 for another try at being released on bail.
