Reasons for Order (Harkat certificate deemed reasonable) | |
Description | Justice Dawson's decision on Mohamed Harkat. She upholds the reasonableness of the certificate. She also rejects Harkat's claims that sections 77 through 81 of the IRPA (Immigration and Refugee Protection Act) are unconstitutional. They ARE constitutionally sound, she says. Her reasons? None are given. She sidesteps the issue entirely, refering only to decisions by two other judges on entirely different cases: Ahani and Charkaoui. The security certificate is now a DEPORTATION ORDER. The Canadian government will now seek to deport Mohamed to Algeria. |
