On April 11, Come to Court re Mahmoud Jaballah

PLEASE ATTEND AT THE ONTARIO COURT - 361 UNIVERSITY AVENUE - AT 10 AM ON FRIDAY APRIL 11, 2003 FOR THE HEARING OF AN ABUSE OF PROCESS MOTION ON THE JABALLAH CASE.

Mr. Jaballah was illegally detained and tortured in Egypt by Egyptian authorites. He fled Egypt with his family and eventually arrived in Canada where he, his spouse and his children all made refugee claims.

In March 1999 Mr. Jaballah was arrested and detained without bail on his 1st CSIS security certificate on allegations of "association with a terrorist group". At the same time their refugee claim was denied but their lawyer Rocco Galati successfully appealed to Federal Court on the basis that CSIS illegally intereferd with the refugee process. The claim was sent back for a new hearing. In September 2000 the Federal Court quashed the CSIS certificate and Mr. Jaballah was released.

In August 2001, when their refugee claim was scheduled to be heard Mr. Jaballah was re-arrested on a 2nd CSIS certificate on the EXACT SAME ALLEGATIONS AND apparently THE SAME EVIDENCE. He was detained in maximum security jail without bail, often in punative segregation--solitary confinement. Again the refugee claim was cancelled and only rescheduled after their lawyer brought a contempt motion against the Board. Prior to the refugee hearing the Minister of Immigration performed a risk assessment and made a decision that Jaballah WOULD BE TORTURED AND KILLED IF RETURNED TO EGYPT!

Despite this long ordeal neither Jaballah nor any of his family members have been granted convention refugee status and the federal court has still not ruled on the 2nd CSIS certificate. While Mr. Jaballah still languishes in jail seperated from his wife and children.

The Jaballah case exemplifes the criminalization of Arabs and Muslims, particularily those who are politically active or have strong religious convictions, in that if you are Muslim/Arab you can expect to be accused without seeing the evidence against you, imprisioned for long and indefinate periods without bail, and without being criminally charged, convicted or sentenced!!

PLEASE ATTEND AT COURT ON FRIDAY AND SEE FOR YOURSELF HOW THE SAGA WILL UNFOLD IN THE LEGAL SYSTEM!!

YOUR PRESENCE IS CRUCIAL, even for an hour or so, take a short break from work and come down to the courthouse and let the judge know that there IS a community out there who is scrutinizing these types procedings.
